Transportation services in Slovenia - changes of legislation

There have been some changes in the legislation for companies in Slovenia offering transport services. Certain segments of the new legislation will come into force on 23rd November 2019 because the parliament accepted the amendment of the Road Transport Act (ZPCP-2G). These changes will affect the companies doing business in Slovenia connected to transportation services.

Who is the transport manager in a company offering transportation services?

The main change which this amendment foresees is connected to the transport manager. The Road Transport Act foresees the transport manager as a natural person employed in the company, who actually and on a permanent basis organizes the transport services in the company. Having a transport manager is a mandatory part if you plan to obtain a license for international transport of goods for vehicles over 3.5 tons or for transportation of passengers. The person, who is the transport manager, has to have professional qualification to offer this service.

A company offering transportation services, has to name at least one person in the company as transport manager. That person has to:

  • fulfill the condition of professional qualification,
  • actually and without interruptions leads the transport services of the company
  • has actual connection to the company and lives in an EU member state.

That person is considered an internal transport manager.

A company can also have an outside transport manager if they conclude an Agreement of professional cooperation with a company that has a transport manager.

What are the changes in the legislation for transportation services regarding the transport manager?

Up until the amendment, the conditions for companies offering transportation services were that they have to name one person as transport manager. That person had to fulfill the following conditions:

  • actually and without interruptions leads the transport services of the company
  • has actual connection to the company (has to be an employee, director, or shareholder)
  • lives in an EU member state.

What are the other novelties when obtaining license for international transportation for companies offering transportation services?

The most important change for companies offering transportation services is that the transport manager can offer the service only in one company and has to be employed in that company for full-time. The only exception is if that person is at least 50% shareholder in that company.

If the company does not have an internal transport manager, they have to name a natural person, offering transport manager services. That person is a contractual transport manager. They can offer their services under the following conditions:

  • they can offer their service only in 1 company,
  • the company cannot have more than 5 vehicles,
  • that person cannot be a transport manager in another company.

There are also additional conditions for companies offering transportation services that come into force with this amendment:

  • the company has to have employed a particular number of employees in relation to the number of vehicles that are a subject of the license,
  • the company would also have to report the number of employees that are present in the company’s business premises during business hours,
  • also, the company has to have appropriate business premises.

Even companies who already have obtained this license, would have to fulfill these conditions within 1 year from this law coming into force.
