Exceptions – When can you start the procedure earlier?
There are also some exceptions! For instance, if your residence is in the interest of the country. For that, you must get an opinion by competent authority in the Republic of Slovenia (ministry or state authority). Also, this expresses the interest of the foreigner’s residence in Slovenia. Moreover, the administrative unit then decides about the application on the basis of the opinion. Who are family members?
According to the Aliens Act (ZTuj-2), family members in the context of family reunification are:
- a spouse, a partner in a civil partnership or a partnership, or a partner with whom the foreigner has a long-term living arrangement;
- minor unmarried children of the alien;
- minor unmarried children of the spouse, civil partner or partner with whom the alien lives in a long-term relationship;
- the parents of a minor with whom the alien was living in a family partnership prior to his/her arrival in the Republic of Slovenia;
- adult unmarried children and parents of the alien; the spouse; the partner in a civil partnership or a partner with whom the alien is living in a long-term relationship, whom the alien, his or her spouse, civil partner, or a partner with whom the alien is living in a long-term relationship is obliged to sustain under the law of the country of which he or she is a national.
