If you are not the owner of the business address, you must submit a certified statement of the owner of the property. It is required at company registration. This statement allows you to register the business address at that location. This also means that in this case, you and the owner of the business premises must enter into a rent agreement for the use of these business premises.
Can you have a company registered address in Slovenia without the consent of the owner?
If you rent the office from a company, which is not the owner of the premises, obtaining their signature and their consent is not enough. The statement must be certified by the owner of the premises. The content of the statement is important, not the form itself.
The form with which the owner allows the registration of a business address must contain:
- data of the owner of the business premises (their name, address, tax number);
- it must show which space the entrepreneur will use for the company registered address
- at the same time, the owner issues the consent to the company, which will use the address (name, tax number and the address).
Which are the responsibilities of the owner of the premises?
The owner who gives the consent to register a business address is liable for damages caused to the building. Liability for damages is based on the law. So, the owner of the business premises cannot avoid it by referring to the contractual relationship with the subtenant.
If you want to carry out the activity in a private house or an apartment, you must obtain a permit to change the purpose of the property.
How can the owner of the business premises remove a company from the registered address? Pursuant to the Financial Operations, Insolvency Proceedings and Compulsory Dissolution Act (ZFPPIPP), the owner of the business premises may propose to initiate the procedure of the deletion of the company from the business address. The owner has to submit the request to the court. Then the court initiates the deletion of the company from the business registry.
