Sickness benefit or its amount depends on the reason for the insured person’s absence from work. Sickness benefit: who are the insured persons and what is the basis for the benefit?

Insured persons are employees, persons who independently perform economic or professional activity, partners of partnerships, partners of limited liability companies and also founders of institutions. Insured persons  are also top athletes and top chess players, foster parents and also farmers, if they are insured under this activity. Under certain conditions, also unemployed persons fall in this category . The basis for sickness benefit is average monthly salary and benefits paid in the calendar year preceding the year in which the temporary absence from work occurred.

Sickness benefit: amount and eligibility

Given that, due to the global health crisis, the reason for dealing with absence from work and sickness benefits may also be related to COVID-19, we illustrate the reasons for absence from work in two tables below.

An employee who is absent due to illness for up to 3 working days in a row may be absent without a certificate of justified absence from work. Intervention Act on Interim Measures for Mitigation and Elimination of Consequences COVID-19 (ZZUOOP) adopted the right of absence from work.

Such a worker has the right to 80 % of the salary compensation. The worker can invoke the right once in a calendar year. Absence to up to 30 working days is paid by the employer. For the duration of further absence from 30 days onwards, the insurance office pays the sickness benefit.

INJURY AT WORK

If a COVID-19 infection occurs in the workplace and then the insured person becomes ill with COVID-19 (e.g., nurses at a nursing home). 100% from 11 April 2020 onwards to 31 May 2020 at the expense of the ZZZS,

from 1 June 2020 onwards, the employer pays salary compensation to his debit for the first 30 working days.

CHILDCARE

If a child is infected with COVID-19, the parent is entitled to childcare for the time the child has to be at home due to the disease. 80% Compensation is paid by ZZZS from the first day of absence from work

Compensation for sick leave – who is not entitled?

  • insured persons working from home;
  • healthy persons who are unable to work for reasons of force majeure (e.g. childcare, absence of public transport);
  • healthy persona in the event of prescribed quarantine.
