Annual leave in Slovenia – the allowance is the right of the employees

Annual leave allowance is the right of employees who also have the right to annual leave in Slovenia. The Employment Relationships Act (ZDR-1) stipulates that it must be paid at least in the amount of the minimum wage. The law also sets a deadline by which you have to pay it. Retirees also receive annual leave allowance.

Annual leave in Slovenia – the allowance for the year 2021

In accordance with ZDR-1, the holiday pay must be paid at least in the amount of the minimum wage in the Republic of Slovenia. This currently amounts to 1,024.24 EUR, so the minimum allowance for the year 2021 will be at least that much. Employers should also take into account the collective agreement that binds them. Namely, it may also determine the obligation to pay a higher allowance for annual leave in Slovenia than the legal minimum.

What if a worker does not have the employment contract for the entire calendar year?

An employee who is not employed for the entire calendar year has the right to only a part of the annual leave. Namely 1/12 of the annual leave in Slovenia for each month of employment. Consequently, such a worker also has the right to only a share of the annual leave allowance. Also in this case 1/12 of the full allowance for each month of employment. Deadline for the payment of the annual leave allowance

You have to pay the holiday pay to the employees no later than 1 July of the current calendar year. A collective agreement may set a later deadline for payment, but only in the event of the employer’s illiquidity. In this case, too, you must pay it no later than 1 November of the current calendar year.

The annual leave in Slovenia and part-time employment

If a worker works only part-time, this may affect his right to the holiday pay. If the employee has a part-time employment contract, he only has the right to a part of the holiday pay. Do you want to learn more? Write to us on data@data.si.

Workers on sick leave or parental leave

Workers who are absent from work due to illness also have the right to allowance for annual leave in Slovenia in the same way as if they were working. The same applies to workers who take parental leave in an individual calendar year. The condition for the payment of holiday pay is a valid employment contract.
