Posting workers to work abroad is a common practice of Slovenian companies with clients in other EU countries. Many employers require posted workers during the coronavirus epidemic to work in other countries. Contribution exemption and crisis supplement Under The Intervention Act
The COVID-19 Emergency Response and Mitigation Act (ZIUZEOP) provides for exemption from pension and disability insurance (PIZ) contributions to workers who work during an epidemic. It also provides for the payment of crisis supplement to workers working during the epidemic.
The enacted law thus provides that employers are exempt from paying pension and disability insurance contributions. This goes for months of April and May 2020. Every employee who works and whose last paid monthly salary has not exceeded three times the minimum wage, receives a monthly crisis supplement. The amount is 200 EUR per month and is exempt from all taxes and contributions.
Notwithstanding the above provisions of the Act, according to the Financial Administration, this measure also applies to March 2020.
Do the same measures apply for workers who are posted to work in other EU countries?
What about workers that a Slovenian company posts to work in other countries on projects? The Intervention Act does not exclude posted workers from this measure. Also here employers are exempted from paying pension and disability insurance contributions for posted workers who work during an epidemic.
Those employees also have to receive a crisis supplement. Workers working abroad for the company and whose last paid monthly salary exceeded three times the minimum wage in the Republic of Slovenia also do not receive crisis supplement.
