Do I automatically obtain a single work and residence permit by opening a company in Slovenia?

Did you know that you do not automatically obtain a single work and residence permit by opening a company in Slovenia?

Many foreigners think that by opening a private limited company (LTD) and depositing the founding capital in the amount of 7.500 EUR or buying an existing LTD they can obtain right to work in Slovenia and in the EU. This is in fact, not correct. Simply by owning a LTD and being named representative in the company you do not have the right to work and reside in Slovenia.

If you are already employed for a full work-day in your homeland and do not plan to actively work in the company in Slovenia, subsidiary or branch office and do not plan to spend more time in Slovenia than the period allowed by your tourist or work visa, you do not need to be employed in your company. The choice is yours.

If you plan to be employed in your future company and obtain a single work and residence permit, which will also allow you to move throughout the EU freely, you have to submit the application for a single work and residence permit after the company registration.

You can do that if the company fulfills one of the following conditions:

  • Makes an investment of a minimum of 50.000 EUR to the fixed assets of the company in the first 6 months after the company registration.
  • Has a person employed for a full work-day at least 6 months before submitting the application
  • The company generates revenue in the amount of 10.000 EUR each month in the past 6 months before submitting the application (this is proven by issued invoices and their respective inflow to the company’s bank account)

In one LTD, one person can obtain a single work and residence permit for a foreign representative. All others have to be employed through Slovenian labor market control.

There is one alternative option of obtaining a single work and residence permit that does not require that the company fulfills the aforementioned conditions. If you are a highly qualified person, who has obtained at least a university degree you can be obtained through Slovenian labor market control based on your higher education. This individual can be a shareholder in the company, be he must not be a representative in the company.

If a Slovenian company wants to employ a foreigner with at least a university degree, the company does not need to prove active business conduct or make the investment of 50.000 EUR in fixed assets. The company only has to obtain the confirmation from the Employment office of the Republic of Slovenia that there are no suitable candidates for this job position in the unemployment registry.
